The stories that followed were increasingly bizarre: tales of the carrier’s owner personally driving the refrigerators through Poland to pay fines for the first truck, followed by an alleged altercation with Polish police and a stint in jail, rendering the second transport undeliverable and the fate of the first shipment severely uncertain. This was the chaotic scene into which we were called, a situation that had already reached peak stress levels for our client.

With both consignees demanding answers every ten minutes and our client’s insurer completely in the dark, immediate action was critical. Our first move: inform all relevant insurers – our client’s and the carrier’s liability insurer. We then initiated a multi-pronged approach, characterized by unwavering transparency and strategic action:

    • Polish Legal Maneuvers: We engaged a partnering law firm in Poland. Their mission: to liaise with the local transport inspectorate, locate both trucks, and demand their immediate release.

The situation escalated, reaching near-constitutional levels in Poland, as no authority seemed willing to take responsibility for releasing the detained goods.

Then, a glimmer of hope. A miracle occurred. The Regional Transport Directorate, with the Transport Ministry’s approval, finally permitted the transshipment of the goods to another truck, under strict surveillance of the Polish authorities.

By this point, the cargo owner, having lost all hope, had invoked their rights under the CMR Convention, declaring the goods lost after sixty days and submitting a claim for the full commercial value. Through persistent negotiation and a commitment to transparency, we convinced the client to withdraw the full claim, agreeing to a settlement where only unsellable goods would be claimed once they reached Sweden and were quality-checked.

Finally, nine months after our initial involvement and ten months after the original loading, the cracker shipment arrived in Sweden. Two months into 2025, the quality checks confirmed our strategic gamble: despite being locked in a trailer for ten months and enduring all four seasons, the unsellable portion was minimal.
