In the cutthroat world of freight forwarding, where timing is everything and trust is currency, imagine a scenario that spirals from a routine shipment into a high-stakes international mystery. This isn’t just a legal case; it’s a testament to the power of transparency, meticulous risk management, and a touch of “fright or freight” in navigating the unexpected.

It all began in late 2023, as the festive Christmas season approached. Our client, a leading Central European freight-forwarder, entrusted a familiar Serbian carrier with a crucial shipment of “Balkan” crackers and cookies, destined for the Swedish market. This carrier had a sterling track record, having completed a dozen successful transports, cementing a bond of trust.

Initially, everything seemed on track. Communication flowed smoothly until, just as the truck approached its ferry crossing from Northern Poland to Sweden, an eerie silence descended. The carrier vanished, plunging our client into a logistical nightmare, leaving them unable to book the vital ferry and risking significant delays for time-sensitive goods.

Days after New Year’s Eve, the ghost reappeared. The carrier, now in contact, revealed a critical problem: the truck was detained in Poland. The driver lacked the necessary documents for transit through Europe, a strict requirement for non-EU Serbian vehicles crossing Polish borders. Adding to the drama, the carrier claimed financial distress, pleading for another transport to cover the hefty Polish detention fees.

Given their long-standing positive relationship, our client, against their better judgment, agreed, dispatching a second load – refrigerators, also from Serbia to Sweden. And then, like a plot twist in a thriller, the carrier vanished again, going completely dark shortly after picking up the second consignment.

The stories that followed were increasingly bizarre: tales of the carrier’s owner personally driving the refrigerators through Poland to pay fines for the first truck, followed by an alleged altercation with Polish police and a stint in jail, rendering the second transport undeliverable and the fate of the first shipment severely uncertain. This was the chaotic scene into which we were called, a situation that had already reached peak stress levels for our client.

With both consignees demanding answers every ten minutes and our client’s insurer completely in the dark, immediate action was critical. Our first move: inform all relevant insurers – our client’s and the carrier’s liability insurer. We then initiated a multi-pronged approach, characterized by unwavering transparency and strategic action:

Polish Legal Maneuvers: We engaged a partnering law firm in Poland. Their mission: to liaise with the local transport inspectorate, locate both trucks, and demand their immediate release.

Serbian Search and Rescue: Simultaneously, we alerted the prosecutor’s office in Serbia, reporting the carrier’s actions as potential theft. This triggered search warrants and dispatched search parties across Serbia, guided by the scant GPS data we had on the trucks.

Weeks later, a breakthrough! The refrigerator truck was found in a rural Serbian backyard, load miraculously intact. We swiftly coordinated with the owner for instructions, navigating the complexities of cancelling export documents since the goods hadn’t left Serbia. The goods were eventually delivered to the owner’s specified address, a goodwill gesture by our client to rectify the carrier’s blunder.

The first load, the elusive crackers, was located in Poland. Here, our real battle against bureaucracy began. Documents flew across Europe in a relentless effort to secure the truck’s release. The situation escalated, reaching near-constitutional levels in Poland, as no authority seemed willing to take responsibility for releasing the detained goods.

Then, a glimmer of hope. A miracle occurred. The Regional Transport Directorate, with the Transport Ministry’s approval, finally permitted the transshipment of the goods to another truck, under strict surveillance of the Polish authorities.

By this point, the cargo owner, having lost all hope, had invoked their rights under the CMR Convention, declaring the goods lost after sixty days and submitting a claim for the full commercial value. Through persistent negotiation and a commitment to transparency, we convinced the client to withdraw the full claim, agreeing to a settlement where only unsellable goods would be claimed once they reached Sweden and were quality-checked.

Finally, nine months after our initial involvement and ten months after the original loading, the cracker shipment arrived in Sweden. Two months into 2025, the quality checks confirmed our strategic gamble: despite being locked in a trailer for ten months and enduring all four seasons, the unsellable portion was minimal.

Through our relentless efforts, strategic negotiations, and unwavering commitment to transparency, we achieved remarkable results:

Refrigerator Redemption: The refrigerator case was resolved without a claim for delay or damage. Our client, demonstrating true partnership, even waived the freight invoice for the carrier due to the inconvenience.

Bureaucracy Bested: We successfully navigated the labyrinthine Polish bureaucracy, securing permission to reload the cracker shipment for its final journey to Sweden.

Claim Catapulted: Most impressively, we reduced a staggering EUR 50,000 claim down to a mere EUR 2,500. This was a direct result of critical thinking, strategic negotiations, and open communication with the client, preserving vital commercial relations through a goodwill payment.

At Cargofort, we believe that complex claims aren’t just legal hurdles; they are opportunities to demonstrate unparalleled expertise, foster trust through transparency, and ultimately, save our clients significant resources. This case stands as a shining example of how understanding the intricate dance between law, logistics, and risk management, infused with a good dose of proactive problem-solving, can turn a potential disaster into a resounding success story. We take our clients’ needs seriously and treat their business relationships with the utmost care they deserve.

Failure to follow transport instructions correctly can have serious legal, financial, and operational consequences. This case study outlines a real incident where improper handling of a minor procedural issue led to a rejected shipment, a held-up driver, and the eventual destruction of goods. Learn why following the instructions of the entitled party isn’t just a formality—it’s a necessity.

The Situation

Our client, a freight forwarding company, managed a shipment of chemical compounds for the cooking industry. The goods were to be transported from Bulgaria to Germany under strict conditions: they were sealed with both a commercial and a customs seal. Maintaining these seals intact was a non-negotiable condition for the buyer to accept delivery. Any deviation would trigger a full rejection.

The Problem

At the Romanian border, customs officials removed the customs seal for inspection. The driver replaced the seal but did not:

Document the replacement in the CMR Consignment note

Notify the freight forwarder

As per the agreed transport protocol, this replacement should have been reported immediately to allow the consignee to prepare for the discrepancy. But because the change wasn’t recorded or communicated, the consignee rejected the goods upon delivery due to the different customs seal.

The Fallout

We were brought in after the rejection. We contacted the client’s contractual partner to request that the consignee reconsider, since the commercial seal was intact and the product was unharmed. The consignee allowed an inspection on-site. The surveyor confirmed the goods were untouched and usable.

Still, the consignee maintained the rejection. With no official instructions on what to do next and a driver stuck on-site for four days in the middle of summer, the carrier had no choice but to return the goods to Bulgaria.

Legal Background: CMR Convention Articles 14 & 15

Article 14(1): If the contract can no longer be executed per the CMR note, the carrier must request instructions from the party entitled to dispose of the goods.

Article 14(2): If no instructions are received in time, the carrier may act in what they believe is the best interest of the entitled party.

Article 15(1): If delivery is prevented at the destination, the carrier must contact the sender for instructions.

What Went Wrong

The consignee’s instructions came too late—only after the shipment was already en route back to Bulgaria

The driver was kept in limbo for days with no resolution or directive

Communication gaps between the freight forwarders, carrier, and sender delayed action

The ultimate outcome? The goods were destroyed. Liability and compensation issues remain unresolved

Key Takeaways

Every seal matters – Even a minor customs seal issue can result in full rejection.

Record everything – Any change must be noted in the CMR and communicated immediately.

Silence is costly – Lack of timely instructions leaves carriers with no choice but to make executive decisions.

Delays hurt everyone – The longer the indecision, the higher the chance of loss, destruction, and legal trouble.

Respect the CMR Convention – Knowing and applying its articles in real-time is critical to mitigating risk.

Final Thoughts

This case underscores the vital importance of coordination, documentation, and proactive communication in international transport. In a system where even a broken seal can ruin a shipment, following the correct procedures isn’t optional—it’s survival.
